Beautobe respects the intellectual property rights of creators, owners, and licensors, and requires all users of the Beautobe Platform (“Platform”) to do the same. This Digital Millennium Copyright Act (“DMCA”) Policy explains how copyright owners can notify Beautobe of infringing content, how users can respond if they believe content was removed in error, and how Beautobe processes DMCA requests internally. Plain English: If someone uploads infringing content, this policy explains how to take it down. If content is removed by mistake, this policy explains how to get it restored. Beautobe will act quickly and fairly when notified.

If you believe your copyrighted work has been copied, posted, or otherwise made available on the Platform without authorization, please send a written notice to Beautobe’s Copyright Agent. Your notice must include (17 U.S.C. § 512(c)(3)):

  • Your physical or electronic signature.
  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the infringing material, with enough detail (e.g., URL, product listing, or description) for us to locate it.
  • Your contact information (address, telephone number, and email).
  • A statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

If you believe that material was removed or disabled by mistake or misidentification, you may submit a counter-notice to Beautobe’s Copyright Agent. Your counter-notice must include:

  • Your physical or electronic signature.
  • Identification of the material removed or disabled and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled due to mistake or misidentification.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the U.S. District Court for the Southern District of New York, and that you will accept service of process from the person who filed the original notice or their agent.

Beautobe will, in appropriate circumstances, disable or terminate the accounts of users who are repeat infringers.

Beautobe will handle DMCA notices and counter-notices using the following internal process:

  • Monitoring: Support team checks the copyright@ inbox daily.
  • Logging: Every notice and counter-notice is logged in Beautobe’s DMCA Register (date, sender, material, type of notice, action taken).
  • Escalation: Notices are forwarded to Beautobe’s Legal/Operations contact for review before action.
  • Action (valid notice): If the notice is valid, Beautobe promptly removes or disables the identified content.
  • Action (valid counter-notice): If a valid counter-notice is received, Beautobe may restore the material within 10–14 business days unless a lawsuit is filed.
  • Recordkeeping: All notices, counter-notices, and actions taken are retained for at least 24 months.

Under 17 U.S.C. § 512(f), any person who knowingly misrepresents material or activity as infringing may be liable for damages, including attorneys’ fees.
